Information Commissioner Gitanjali Gutierrez issued Decision 21/2023 in regards to the Ministry of Finance Headquarters.
A spokesperson said, “On 1 August 2023, Information Commissioner Gitanjali Gutierrez issued Decision 21/2023, Ministry of Finance Headquarters [Ministry Headquarters]. The Applicant had submitted a Public Access to Information [PATI] request to the Ministry Headquarters for its records on tech companies BPMS Ltd, Innofund Ltd, Innofund Innovation Incubator Ltd and the Fastpass port of entry system.
“The Information Commissioner found that the Ministry Headquarters did not issue an internal review decision to the Applicant within the 6-week timeline set out in the PATI Act. The Information Commissioner has ordered the Ministry Headquarters to issue an internal review decision on or before Tuesday, 5 September 2023.
“This Decision does not address whether or not the Ministry Headquarters has properly denied access to the requested records. Rather, it addresses the basic obligation upon the Ministry Headquarters to respond to an internal review request within the statutory timeframe.”
